Re: Letter to the Head Master

Bbb, you certainly need a competent lawyer to handle your claim against CH - and the perpetrator if they have assets. Meet Reid if you think it will be helpful to you, but don’t agree anything with him or anyone else from the school without a good lawyer present. I am confident that his sympathy an...

Re: Roger Martin

Not necessarily more than one person. It means other evidence. Forensic evidence (blood, DNA) etc would do. With the filthy five, the other complaints would probably have been regarded as corroboration. In those days the other complaints might have been similar fact evidence too. But the basic princ...

Re: Roger Martin

In about 1994 the concept of corroboration which had previously existed in English law was abolished. I cannot remember the precise mechanics but corroboration was: (i) independent evidence; which (ii) points to the involvement of the accused in the crime charges. It means a person cannot be convict...

Re: Letter to the Head Master

The practice of suspension without pay was the same then. Where a person was effectively caught in the act of committing an offence and then admitted to it, the employer was often excused a massive investigation in those days. If the employer got something wrongly procedurally, the Tribunal could pu...

Re: Letter to the Head Master

According to the Court of Appeal transcript (para 9) Webb admitted what he had done to staff at the school in 1984.

An employer can only suspend on full pay if the contract of employment allows it. For some reason, very few do.

Re: Expelled

Yes I've come to the same conclusion JR. Listening to my kids and their friends way back when (and even allowing for a bit of bragging) I got the impression that 14 seemed to be a typical age for some kind of serious sexual involvement. Fascinating how different societies see these things. In our d...

Re: It's time for Sillett, Cairncross and Poulton to comment.

REPLYING TO RichardB it is not of marginal significance if the whole thrust of the 92 amendment was to provide anonymity for sexual abuse sufferers where the abuse did not go as far as what was classed as rape then - especially if the advice cairncross is said to have given was made before that ame...

Re: It's time for Sillett, Cairncross and Poulton to comment.

I have never known a child witness in a sex case be identified in the media. That has never changed and never will.
Nuances in legislation that we had to take on board 25 years ago don't change that.

Re: It's time for Sillett, Cairncross and Poulton to comment.

And as Baker is dead there is zero chance of getting the whole truth as to the difference between the circumstances I am also waiting for some kind of comment form our legal poster as to why he had not noticed that the law on anonymity changed in 1992 in a way particularly pertinent to this case - ...

Re: It's time for Sillett, Cairncross and Poulton to comment.

If a victim is so severely damaged by the abuse that they cannot work, why shouldn't they be compensated for loss of earnings?

The damage very often scars for life.

Re: It's time for Sillett, Cairncross and Poulton to comment.

I would like the school: (i) to accept responsibility for what occurred such as moving people on, giving glowing references, etc; and (ii) to compensate victims properly and in accordance with settled principles of law.

Re: It's time for Sillett, Cairncross and Poulton to comment.

Wurzel, 1. Do you condemn the abuse that undoubtedly occurred? 2. Do you think that there are more victims than those who were named in the various indictments at court? 3. Do you think the victims should be properly compensated? 1. Totally and utterly 2. During my time period not sure, ever defini...
